Terms and Conditions of Business

The Company’s primary concern is to provide a high quality service and as such would not seek to enter into a long and unnecessarily detailed contract for service. It does however acknowledge that its areas of responsibility and obligations should be clearly defined in writing to its clients who should also be aware of the level of protection offered to them and of their obligations to the Company.

Throughout these terms and conditions the “Company” is Jennifer Ashe & Son Funeral Directors Ltd or any subsidiary or trading name used by it.

1. The Right to Arrange the Funeral

The Company has no means of independently establishing who has the legal right to arrange a particular funeral and it will therefore contract with any person that purports to have the authority to arrange the funeral by virtue of being the next of kin, an executor of the estate or acting on the instructions of those persons or in the absence of the existence of any executor or family. Throughout these terms and conditions this person is the “client”.

2. General Observations

The Company employs highly qualified and experienced staff who will use their best professional skills to ensure that the requests of its clients are honoured. During the initial planning the Company representative may not be aware of all the individual family circumstances, the nature of the deceased’s passing and the general condition of the deceased to enable viewing in our chapels of rest.

As these are disclosed it may transpire that certain requests cannot be met. In these circumstances the Company will assist in making alternative arrangements, but it will not accept any liability for additional costs or losses that may arise as a result.

3. Changes to Funeral Arrangements

Funeral dates and times cannot be guaranteed until final bookings are made and confirmed by all third parties involved. Occasionally changes may be required due to circumstances beyond the Company’s control.

The Company does not accept liability for delays caused by third parties or external factors including road conditions, weather or mechanical failure. Charges remain payable in full.

Some services involve animals or vintage vehicles which may be affected by weather or mechanical limitations. The Company accepts no liability should these circumstances arise.

4. Hygienic Treatment, Clothing and Personal Effects

The deceased is transferred in the clothing worn unless instructed otherwise. For health and safety reasons, soiled clothing may be removed and disposed of.

All deceased receive hygienic treatment, which may include embalming where required. By proceeding with our services you give permission for this where necessary.

The Company does not accept responsibility for valuables unless specific instructions are provided. Jewellery and personal items should be collected before the funeral if you wish to retain them.

5. Size of the Deceased

Prices quoted assume standard coffin sizes. Where the size exceeds standard limits, additional staff, equipment or alternative arrangements may be required.

Any additional costs will be clearly shown on the final invoice.

6. Right to Cancel the Contract

Under the Consumer Contract Regulations 2013, clients may cancel within 14 days of signing the agreement.

Cancellation must be sent in writing to:

If services are required within this period, written consent is required and charges will apply for work completed.

7. Cremated Remains

The Company will follow client instructions regarding cremated remains unless legal requirements dictate otherwise.

Where remains remain uncollected for 10 years, and no instructions are received, the Company reserves the right to respectfully disperse them after written notice.

8. Donations and Memorial Pages

Where requested, the Company may create an online memorial page to facilitate charitable donations.

This will include relevant details of the deceased and funeral arrangements. By proceeding, you consent to the creation and publication of this page.

9. Third Party Services

The Company acts as an agent when arranging third party services such as clergy, crematoria or cemeteries. These providers are responsible for their own services.

The Company accepts no liability for errors or issues caused by third parties.

10. Data Protection

The Company respects the confidential nature of client information and ensures it is handled securely and only used for the provision of services.

Some information relating to funeral arrangements may be considered public and shared where appropriate.

11. Liability for Payment

The client remains personally responsible for all charges, even where invoices are sent to another party.

Any shortfall in third party contributions or grants remains the responsibility of the client.

12. Payment Terms

Full payment is required no later than three days prior to the funeral.

Where payment is not received, the Company reserves the right to postpone the funeral or terminate services.

Outstanding balances may incur interest and administration fees. Unpaid accounts may be referred to debt recovery agents and additional costs may apply.
